Terms of Use

These Terms of Use govern your access to and use of the CIGSOR service, website, app, hardware and related services provided by X-SOR AG.

General Terms and Conditions of Sale and Use

These General Terms and Conditions of Sale and Use govern the purchase of CIGSOR products through the online shop and the use of the CIGSOR app, connected sensors, cloud functions and other CIGSOR services.


1. Provider and scope

The provider of CIGSOR products and services is:

These Terms apply to orders placed directly through the CIGSOR online shop and to the use of the CIGSOR app, sensors, cloud platform and related functions. For purchases from an independent retailer, the retailer’s terms generally apply to the purchase contract; product-related terms of use and warranty terms of X-SOR AG may apply in addition.


These Terms apply to consumers and business customers. A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. Mandatory statutory rights of consumers remain unaffected.


Any conflicting or supplementary terms of the customer apply only if X-SOR AG has expressly agreed to them in text form.


2. CIGSOR products and connected services

CIGSOR consists of a physical sensor and digital functions, in particular the CIGSOR app and cloud-based services. Depending on the model and the app version available at the relevant time, these may include the measurement and display of humidity and temperature, battery status, Wi-Fi signal, statistics, notifications, ventilation reminders, management of multiple humidors, inventory functions, sharing functions, location functions and the Cigar Scanner.


The essential characteristics of a product are set out in the product description, technical specifications and information displayed in the online shop at the time of the order. Images are for illustrative purposes. Minor variations in colour, surface, weight or design that are technically unavoidable or result from production do not constitute a defect, provided that the agreed characteristics and normal use are not impaired.


CIGSOR is a monitoring and information system. The sensor measures environmental conditions but does not regulate humidity or temperature and does not replace the proper care, inspection or ventilation of the humidor.


3. Requirements for ordering and use

Orders and the creation of a user account may only be made by persons who are of legal age and have legal capacity, or with the consent of their legal representative. Business customers act through duly authorised persons.


The customer must provide complete, accurate and up-to-date information when ordering and registering. Any changes relevant to contract performance, delivery, invoicing or account security must be updated or communicated without delay.


4. Offer, order and conclusion of contract

The presentation of products in the online shop constitutes an invitation to place an order and is not a binding contractual offer by X-SOR AG.


The customer may select products, place them in the shopping cart and correct input errors before submitting the order. By clicking the final order button, the customer submits a binding offer to purchase the products contained in the shopping cart.


The contract is concluded when X-SOR AG confirms the order by email. A purely technical acknowledgement that expressly confirms only receipt of the order does not yet constitute acceptance. X-SOR AG may reject an order in particular if a product is unavailable, if there are obvious pricing or product errors, if payment fails, if misuse is suspected or if legal restrictions prevent delivery.


The contract text and order data are stored in accordance with statutory and operational retention requirements. The customer receives the essential order information by email.


5. Prices, taxes and additional costs

The prices displayed in the online shop at the time of the order apply. The shop indicates whether a price includes Swiss value added tax or whether taxes are calculated only during checkout.


Shipping costs and any additional charges are displayed before the order is completed. For deliveries outside Switzerland, import taxes, customs duties, clearance fees or other public charges may be imposed in the destination country. Unless expressly stated otherwise during checkout, the recipient bears these costs and is responsible for the relevant import obligations.

Obvious pricing or calculation errors may be corrected by X-SOR AG. If the contract has already been concluded, X-SOR AG will inform the customer and offer either performance at the correct price or cancellation of the contract at no cost.


6. Payment

The payment methods available in the online shop are displayed during checkout. Credit and debit card payments are processed through Stripe.


The purchase price becomes due upon conclusion of the contract unless otherwise stated during checkout. The payment method may be charged immediately after the order is placed. If payment fails or is reversed, X-SOR AG may withhold delivery or cancel the contract after granting a reasonable period for payment.


The customer is responsible for the accuracy of the payment details and for being authorised to use the selected payment method.


7. Delivery and delivery times

Delivery is available to the countries and regions selectable in the online shop. Estimated delivery times are stated in the shop, during checkout or in the order confirmation. They are estimates unless expressly designated as binding.


Unless a different delivery period has been agreed, delivery will take place within a reasonable period. Mandatory statutory delivery periods, in particular consumer rights in the event of non-delivery, remain unaffected.


X-SOR AG may make reasonable partial deliveries provided that the customer does not incur additional shipping costs and the partial delivery can be used meaningfully by the customer.

If a shipment cannot be delivered because of an incorrect or incomplete address, lack of cooperation, refusal of delivery or failure to collect it, X-SOR AG may charge the reasonable costs of a renewed shipment if the customer is responsible for the failed delivery.


8. Transfer of risk and retention of title

For consumers, the risk of accidental loss of or accidental damage to the goods passes when the goods are handed over to the consumer or to a person designated by the consumer and authorised to receive them. Mandatory statutory provisions remain reserved.


For business customers, risk passes when the goods are handed over to the carrier, to the extent permitted by law.


The delivered goods remain the property of X-SOR AG until payment has been made in full. X-SOR AG may have a retention of title entered in the competent register where this is necessary and legally permissible.


9. Voluntary and statutory 14-day right of return or withdrawal

For goods purchased directly through the CIGSOR online shop, X-SOR AG voluntarily grants consumers in Switzerland a right of return for 14 calendar days from the day on which the consumer, or a person designated by the consumer, receives the goods.


For consumers in countries that provide a statutory right of withdrawal for distance contracts, at least the mandatory statutory rights apply. Any more favourable rights granted under these Terms remain in place.


To exercise the right of return or withdrawal, the consumer must inform X-SOR AG within the applicable period by means of an unequivocal statement of the decision, for example by email to support@cigsor.com. The model form in the Annex may be used but is not mandatory.

The deadline is met if the statement is sent before the applicable period expires.


10. Consequences of return or withdrawal

Following a valid return or withdrawal, X-SOR AG will refund the purchase price received and the cost of the least expensive standard delivery method offered for the order. Additional costs resulting from an express, premium or other more expensive delivery method selected by the customer will not be refunded.


The refund will generally be made using the same payment method as for the original transaction unless expressly agreed otherwise. No additional fees will be charged for the refund.


X-SOR AG may withhold the refund until the goods have been received or the consumer provides evidence that the goods have been returned, whichever occurs first.

The consumer must return the goods without undue delay and no later than 14 calendar days after submitting the return or withdrawal statement. The return address and any additional instructions will be provided by Support.


For a normal return or withdrawal, the customer bears the direct cost of returning the goods. If the goods are defective, damaged or incorrectly delivered, X-SOR AG bears the necessary and reasonable return shipping costs. In this case, the return must be coordinated in advance with support@cigsor.com; where possible, X-SOR AG will provide a return label or reimburse the agreed costs.


The consumer is liable only for any reduction in value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning. More extensive setup, prolonged use, damage, engraving or another alteration may result in a reasonable deduction to the extent permitted by law.


11. Exceptions to the right of return or withdrawal

No voluntary right of return and, where provided by law, no statutory right of withdrawal applies in particular to goods made to the customer’s specifications or clearly personalised. This applies in particular to individually engraved CIGSOR products once personalisation has begun.


Statutory rights relating to defects, incorrect delivery or transport damage remain fully applicable to personalised products.


12. Inspection of delivery and transport damage

The customer is requested to inspect the delivery upon receipt for completeness, visible damage and conformity with the order. Where possible, visible transport damage should be documented with the carrier and also reported to X-SOR AG without delay.


Failure to report immediately does not affect mandatory statutory rights of consumers relating to defects. Business customers must notify visible defects within the period prescribed by law or contract.


13. Rights in the event of defects and statutory warranty

X-SOR AG is responsible for ensuring that, at the time risk passes, the goods have the agreed characteristics and are suitable for their normal use or the contractually intended use. Mandatory statutory warranty and conformity rights remain unaffected.


If a justified defect exists, X-SOR AG may, to the extent permitted by law and reasonable for the customer, initially choose to repair the goods or provide a replacement. If repair or replacement is impossible, disproportionate, unsuccessful or not completed within a reasonable period, the customer may exercise the further rights provided by law, in particular a price reduction or termination of the contract and refund.


No claims for defects exist to the extent that a problem results from improper use, unsuitable batteries, failure to follow installation or operating instructions, unauthorised modifications, external influences, unsuitable environmental conditions, unsupported networks or devices, normal wear and tear, or damage caused by the customer or a third party. Mandatory rights remain reserved.


Consumers in the European Economic Area are entitled at least to the mandatory statutory conformity rights applicable there. A voluntary warranty does not limit those rights.


14. Voluntary 10-year manufacturer’s warranty

In addition to statutory rights relating to defects, a voluntary 10-year manufacturer’s warranty is offered for every CIGSOR edition. The warranty begins on the purchase date and is governed by the X-SOR AG warranty terms published at the time of purchase.


The warranty is an additional benefit. It does not limit statutory warranty rights against X-SOR AG or rights against the retailer from which the product was purchased.


Proof of purchase and identification of the affected sensor may be required to make a claim. Details regarding scope, exclusions, procedure and warranty remedies are described on the CIGSOR warranty page.


15. CIGSOR app and included app functionality

The purchase of a CIGSOR sensor includes access to the CIGSOR app functionality described as fully functional at the time of purchase. No recurring subscription fee is charged for these included app functions.


X-SOR AG may offer additional optional functions or services for a fee in the future. Such optional offers will not make the app functionality included with the sensor purchase retrospectively dependent on a mandatory subscription.


The purchase does not include the costs of a smartphone, computer, batteries, internet access, Wi-Fi, mobile communications, data transmission, an app store account or other third-party services.


16. User account and access credentials

A user account is required to use certain app and cloud functions. The customer must keep access credentials confidential, use appropriate security measures and inform X-SOR AG without delay if unauthorised access or misuse is suspected.


The customer is responsible for activities carried out through the account to the extent that the customer caused them or enabled them through a culpable breach of security or due care obligations.


Humidor sharing and the forwarding of notifications may only be made to persons whose contact details the customer is legally entitled to use. The customer may manage sharing permissions through the available app functions.


17. Licence to use the app and software

For the duration of permitted use, X-SOR AG grants the authorised user a personal, limited, non-exclusive, non-transferable and non-sublicensable right to use the CIGSOR app and the software provided in accordance with these Terms and the applicable app store rules.


In particular, the following are not permitted:

  • copying, distributing, renting, selling or making the software publicly available, except where mandatorily permitted by law;

  • reverse engineering, decompiling or circumventing technical protection measures beyond what is mandatorily permitted by law;

  • accessing non-public interfaces or systems;

  • automated bulk access, scraping, security testing without permission or the distribution of malware;

  • using the services to infringe third-party rights or for unlawful purposes.


18. Technical requirements and setup

For connected functions, the sensor requires in particular a compatible 2.4 GHz Wi-Fi network, sufficient signal strength, suitable batteries, internet access, a supported mobile device and a current or supported app version. Guest networks, captive portals, 5 GHz-only networks or special router and firewall configurations may prevent setup or data transmission.


The user is responsible for proper installation, placement, network configuration and maintenance, for replacing batteries in good time and for following the current setup and operating instructions.


Information regarding battery life, measurement accuracy, signal strength and synchronisation frequency represents typical or expected values under the stated conditions and may vary depending on the environment, humidor material, network, batteries and use.


19. Measurements, notifications and user responsibility

CIGSOR supports the monitoring of a humidor but does not guarantee specific storage conditions and does not automatically prevent drying out, excessive humidity, mould, pest infestation, loss of quality or damage to cigars or other stored items.


Measurements and notifications may be affected in particular by placement, calibration, battery level, signal quality, internet or cloud disruptions, app settings, disabled notification permissions, operating system functions or delays affecting third-party services.


The user remains responsible for regularly inspecting the humidor and stored items, setting appropriate thresholds, reviewing alerts and taking any necessary action independently. CIGSOR is not a security, fire, medical or emergency warning system.


20. Availability, maintenance and updates

X-SOR AG endeavours to provide the app and cloud functions reliably and over the long term. However, uninterrupted and error-free availability at all times cannot be guaranteed. Temporary restrictions may result in particular from maintenance, security updates, disruptions affecting internet, cloud, app store or push services, force majeure or technical changes.


X-SOR AG may further develop and update the app, software and cloud services and adapt them to technical, security-related, legal or operational requirements. Essential core functions promised at the time of purchase may not be permanently withdrawn without an objective reason. Mandatory rights relating to digital elements and required updates remain unaffected.

Users must install security and functional updates made available within a reasonable period. Disadvantages arising solely because a provided and properly communicated update was not installed may be attributed to the user to the extent permitted by law.


If essential cloud functions have to be permanently discontinued, X-SOR AG will, where possible, inform affected users with reasonable advance notice. Statutory claims remain reserved.


21. User content and Cigar Scanner

Users retain their rights to photos, inventory data, humidor names, notes and other content that they enter into or upload to the app.


For the duration and to the extent of the use, the user grants X-SOR AG a non-exclusive right to technically store, reproduce, transmit, analyse and display this content insofar as necessary to provide the selected app, scanner, sharing, support and backup functions.


User images will be used for advertising, public communications or other purposes not required to provide the service only with separate permission or on another valid legal basis.

The user may upload only content that the user is entitled to use. In particular, no unlawful, harmful, misleading content or content that infringes third-party rights may be submitted.


22. External services and app stores

Certain functions may depend on third-party services, for example Wix, Stripe, app stores, cloud, mapping, push, search or communication services. Additional terms and privacy information may apply to the independent services of these providers.


The availability of a third-party service is outside the direct control of X-SOR AG. X-SOR AG is responsible for the selection, instruction and monitoring of its own processors to the extent required by law, but not for independent third-party services that the user chooses to use.


23. Data protection

The processing of personal data in connection with the website, shop, app, sensor, support and connected services is explained in the current CIGSOR Privacy Policy, which is available on the CIGSOR website.


Data protection consents are obtained separately where required. Acceptance of these Terms does not replace consent that requires an active choice under applicable data protection law.


24. Intellectual property

All rights to CIGSOR, the app, software, user interface, trademarks, logos, product designs, texts, graphics, databases and other content provided by X-SOR AG remain with X-SOR AG or the respective rights holders.


These Terms do not transfer ownership or any broader rights of use beyond the rights expressly granted for use in accordance with the contract.


25. Liability

X-SOR AG has unlimited liability for damage caused intentionally or through gross negligence, for injury to life, body or health, for expressly assumed guarantees and in cases of mandatory statutory liability, in particular under applicable product liability law.


In the event of a slightly negligent breach of an essential contractual obligation, X-SOR AG is liable, to the extent permitted by law, only for foreseeable damage typical of the contract.


Essential contractual obligations are obligations whose performance is necessary for the proper performance of the contract and on whose fulfilment the customer may normally rely.

In all other respects, liability for slight negligence is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.


In particular, X-SOR AG is not liable for damage to cigars, humidors or other items to the extent that such damage is not caused by a product or service defect for which X-SOR AG is responsible, but results in particular from unsuitable storage conditions, missing or incorrect humidification, failure to carry out inspections, ignored alerts, unsuitable placement, depleted or unsuitable batteries, network or internet problems, or the conduct of third parties.


For loss of data attributable to the user, liability is limited to the typical restoration costs that would have arisen if appropriate backups had been made, to the extent that such limitation is permitted by law.


26. Force majeure

Neither party is liable for delay or failure to perform to the extent caused by an event beyond its reasonable control. Such events may include natural events, epidemics, war, terrorism, government measures, sanctions, labour disputes, power or network failures, interruptions to international transport routes, cyberattacks or significant disruptions affecting infrastructure and cloud providers.


The affected party will, where reasonable, inform the other party of the event and its expected effects. Payment and refund claims that have already arisen remain unaffected.


27. Suspension, account deletion and termination

The user may have the account deleted using the available app functions or by contacting Support. Account deletion may make cloud-based functions, historical data, sharing permissions and notifications unavailable. Statutory retention requirements and the Privacy Policy remain reserved.


X-SOR AG may temporarily suspend or terminate access if there are specific indications of misuse, security risks, unauthorised access, legal infringements, material breaches of these Terms or a legal obligation. Where possible and reasonable, the user will receive prior notice and an opportunity to remedy the situation. Immediate action may be required in the event of acute security or legal risks.


Suspension or account deletion does not affect statutory claims relating to defects, refunds or damages.


28. Changes to these Terms

A purchase contract is generally governed by the version of the Terms provided when the order was submitted.


For ongoing app and cloud services, X-SOR AG may amend these Terms where this is required for legal, technical, security-related or operational reasons and is reasonable for users. Material changes will be communicated in an appropriate manner before they take effect.

Where a change requires the user’s consent, that consent will be obtained separately. Continued use alone does not constitute consent where applicable law requires express consent.


29. Governing law and jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods, to the extent that its exclusion is legally permissible.

For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence, where those provisions would apply in the absence of a choice of law.


The mandatory statutory places of jurisdiction apply to consumers. X-SOR AG will bring proceedings against a consumer only before a court having jurisdiction under applicable law.

For disputes with business customers, the registered office of X-SOR AG in Bottighofen, Canton of Thurgau, is the exclusive place of jurisdiction to the extent permitted by law. X-SOR AG remains entitled to bring proceedings against the business customer at the customer’s registered office.


30. Final provisions

If any provision of these Terms is wholly or partly invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced by the applicable statutory rule. For consumers, this applies only insofar as no mandatory rights are adversely affected.

Failure to exercise a right does not constitute a waiver of that right.


The German and English versions are made available. In the event of discrepancies, the German version prevails unless mandatory law or an express agreement provides otherwise.
